This agreement constitutes a legally binding agreement between you (natural or legal person, hereinafter referred to as the “User” or “you”) and QW Sp. z o.o. (hereinafter referred to as the “Company”) concerning the use of the “VTT Dice” software line.
1.1 The Company grants you a personal, non-transferable, non-exclusive license, i.e. the right to use the software, solely in the manner and subject to the conditions set out below (hereinafter the “license”).
1.2 The software includes a set of digital files consisting of bone models, a javascript file, a json file, a file with the text of the license for use and a readme file containing the user manual for the buyer.
1.3 The software is designated for use in Foundry VTT type application and operates in that application under conditions and terms of use which are independent of the Company and for which the Company is not responsible.
1.4 The software license is acquired by purchasing the product from the Company’s online store www.q-workshop.com.
2.1 The intellectual property rights in the software (including but not limited to the rights to any databases, artwork, photographs, audio and video recordings and additional programs and other intellectual property embodied in the software), related materials in electronic form and any copies of the software are owned by the Company. All ownership rights and copyrights in the databases and other content accessed using the software are covered by the intellectual property rights or copyrights of the owners of such databases and content, and are protected by law.
2.2 The Company retains ownership of the software originally downloaded by the User and all subsequent downloads of the software by the User.
2.3 The Company reserves the right to license the software to third parties.
2.4 The license is granted for an indefinite period unless otherwise specified in the description of specific software.
2.5 You shall be entitled to use the software solely for your own use, including your own business activities, provided that you are not entitled to distribute or market the software, and in particular not to make the software available to third parties free of charge or to offer the software as your own.
2.6 You are not entitled to sub-license the purchased software or to transfer a purchased license.
2.7 You may not edit, change, modify, adapt, translate or otherwise alter any part of the software.
2.8 You are not entitled to make any part or component of the software available to the public, including creating the opportunity for third parties to copy it.
2.9 The Company is entitled to terminate this license with immediate effect if the User violates its provisions.
3.1 Upon purchase, you will receive the software in the form of a unique hyperlink (link, referrer) assigned to the User’s account to download the software files from the Company’s server.
3.2 You should install the software in the Foundry application according to the guidelines attached in the manual.
3.3 For the software to function properly, you should have installed a module for Foundry VTT called Dice So Nice! available at: https://foundryvtt.com/packages/dice-so-nice. The Company shall not be liable in respect of your use of the module and does not guarantee the availability of the module during the term of this Agreement.
3.4 You should use a device which meets the technical requirements for correct functioning of the software. The User shall bear full responsibility in the above respect.
4.1 The Company ensures the functionality of the software and guarantees the correct operation of the software in the Foundry VTT application issued by Foundry Gaming LLC as of the date on which the software is purchased.
4.2 The Company shall not be liable in any way for the failure of the software to meet the User’s expectations and requirements.
4.3 The Company shall not be liable for any inability to use the software in the event that applications designated for the use the software are suspended or unavailable.
4.4 The Company shall not be liable if the software is no longer compatible with the third party application.
4.5 The Company guarantees the correct operation of the software as described in the manual and in this Agreement.
4.6 The Company does not guarantee the functioning of the software in case of violation of the conditions described in the manual or in case of violation of this License Agreement.
4.7 The Company shall not be liable for any actions or omissions made by the User while using the Foundry VTT application, in particular with regard to license agreements or any other agreements between the User and third parties necessary for the use of the Foundry VTT application.
5.1 This Agreement, which has been entered into for an indefinite period of time, may be terminated by the Company in the event that you fail to comply with the provisions of the Agreement.
5.2 In the event of termination of the Agreement by the Company, you must destroy all copies of the software in your possession (including all components of the software on any data carrier).
6.1 This Agreement and all disputes arising out of or in connection with this Agreement shall be governed by and construed in accordance with the Polish law.
6.2 The competent court for disputes related to this license shall be the court having jurisdiction over the Company.
